Utah’s Own Qualification Criteria
Overall criteria for Utah’s Own
Both companies and products may qualify for the Utah’s Own program. The Utah Department of Agriculture and Food is the final determinant as to qualification.
Producer and company qualification
An individual or legal entity of the state of Utah may be qualified as a Utah’s Own producer or company. A company not headquartered in Utah may not be a Utah’s Own company but their products may qualify if they meet the Utah’s Own product criteria. Products of franchises, such as fast food restaurants, bottlers, etc. do not qualify.
Product qualification
A product of a qualified individual producer or Utah’s Own company that derives 51% of its derived value from Utah products and services and products produced in Utah by a qualified producer may be a qualified Utah’s Own product. Such products may be designated as Utah’s Own.
A product that is produced or made in Utah by a company not headquartered in Utah and not a franchise company may qualify for the Utah’s Own program provided products to be qualified derive 51% of their value in Utah. Such products shall be designated as “Made in Utah” whenever they refer to their qualification as Utah’s Own.
Derived Value
Derived value – is expressed in per unit value of the finished product. The per unit value may include cost of goods sold if any Utah’s Own qualified product and/or products grown or produced in Utah are purchased as inputs. In addition, marketing and selling expenses when Utah companies are utilized, and profit margins count toward the computation of the derived value of the finished product.
Logo
A qualified company or producer may list themselves as a Utah’s Own company or producer and use posters and other marketing collateral to so note their qualification as a Utah’s Own company or producer. Only Utah’s Own qualified products may use the logo for product labeling or product promotion. Qualified products of non Utah’s Own companies may only use the Utah’s Own Made in Utah logo.
Partnership qualification
A sponsor may list themselves as a Utah’s Own Partner and use the logo with a prominently displayed Partnership designation. There will be a fee paid to the Utah’s Own program associated with qualification as a Utah’s Own Partner. There may be different levels of sponsorship designation.
